These Terms of Service ("Terms") govern your use of www.larkynhomes.com (the "Site") and our text messaging program, both operated by Larkyn Homes, LLC ("Larkyn Homes," "we," "us," or "our"). By using the Site or opting in to our text messages, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Use of the Site

You may use the Site for lawful, personal, and informational purposes. You agree not to:

  • Submit false, misleading, or someone else's information through our forms

  • Interfere with the Site's operation or security, or try to gain unauthorized access to it

  • Use bots, scrapers, or other automated means to copy content from the Site

  • Use the Site to send spam or unsolicited messages

We may suspend or restrict access to the Site at any time without notice.

Project information is not an offer

Content on the Site, including descriptions, photos, renderings, floor plans, features, availability, and pricing for custom homes, ADUs, renovations, and communities such as Canopy at Lullwater, is for general information only. It may change without notice and is not an offer, estimate, or guarantee. Completed-project photos show past work and may include upgrades or furnishings not included in other projects.

Any estimate, proposal, or construction work is governed only by a separate written agreement signed by you and Larkyn Homes. If that agreement conflicts with these Terms, the written agreement controls.

Intellectual property

The Site and its content, including text, photos, designs, plans, logos, and the Larkyn Homes name, are owned by Larkyn Homes or its licensors and are protected by copyright and trademark law. You may view and share Site pages for personal, non-commercial use. You may not copy, reproduce, or use our designs, plans, or photos for any other purpose without our written permission.

SMS / text messaging terms

  1. Program description: Larkyn Homes sends text messages to people who opt in on our website. Messages cover inquiries, appointment scheduling, and project updates. If you separately opt in to marketing messages, we may also send occasional updates about our homes and communities. Consent to receive text messages is not a condition of purchase.

  2. Opting out: You can cancel the SMS service at any time. Text STOP to the number that messaged you. You will receive one text confirming that you have been unsubscribed, and you will receive no further messages. To rejoin, opt in again on our website.

  3. Help: If you have trouble with the messaging program, reply HELP, call 423-509-5881, or email admin@larkynhomes.com.

  4. Carrier liability: Carriers are not liable for delayed or undelivered messages.

  5. Rates and frequency: Message and data rates may apply for messages sent to you from us and from you to us. Message frequency varies. For questions about your text or data plan, contact your wireless provider.

  6. Privacy: For privacy-related questions, see our Privacy Policy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.

Links to other websites

The Site may link to websites we do not control, such as social media pages or partner sites. We are not responsible for their content, terms, or privacy practices.

Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be accurate, complete, uninterrupted, or free of errors or viruses. Warranties for construction work are provided only in your written construction agreement.

Limitation of liability

To the fullest extent permitted by law, Larkyn Homes and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site or our text messages. Our total liability for any claim related to the Site will not exceed $100. This section does not limit any rights under a signed construction agreement.

Indemnification

You agree to indemnify and hold harmless Larkyn Homes and its owners, employees, and agents from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Any dispute related to the Site or these Terms will be brought in the state or federal courts located in Hamilton County, Tennessee, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these Terms from time to time. When we do, we will post the new version on this page and change the effective date above. Your continued use of the Site after an update means you accept the revised Terms. If any part of these Terms is found unenforceable, the rest remains in effect.
